Terms of service

These terms govern your use of Arch, a creative platform for AI-generated video. By creating an account or using the service, you agree to these terms. Please read them carefully.

1. Who we are

Arch ("we", "us") is operated by RART Digital(operating in beta; registration and registered office details will be published upon public release).

2. The service

Arch is a software-as-a-service platform that helps users generate cinematic video content from audio inputs and creative direction. The service combines proprietary orchestration with third-party AI providers for image and video synthesis.

Beta status. Arch is currently in beta. Features may change, evolve or temporarily be unavailable. We continuously improve the platform based on user feedback.

3. Account and eligibility

  • You must be at least 16 years old to use the service.
  • You agree to provide accurate information at signup and keep it up to date.
  • You are responsible for the security of your credentials and for all activity under your account.
  • One account per person. Sharing accounts is not permitted.

4. Credits, plans and billing

Arch operates on a credit-based model. Each second of generated video consumes a fixed number of credits. Credits are obtained through monthly subscription plans or one-time top-up packs.

  • Monthly credits are allocated at each subscription renewal. They reset at the start of each new billing cycle and do not accumulate from one month to the next.
  • Top-up credits are purchased separately and remain available indefinitely on your account.
  • Subscriptions renew automatically until cancelled. You can cancel anytime; your plan will remain active until the end of the current billing period.
  • Plan changes (upgrade or downgrade) take effect immediately. Upgrades are pro-rated; downgrades preserve your current credits until the next renewal.
  • We may adjust pricing with at least 30 days' notice. Existing active subscriptions are honored until their next renewal at the previous price.

5. API keys and third-party services

Arch requires you to provide your own Google Gemini API key for certain generation steps. You are solely responsible for the costs charged by Google for the use of your key, for keeping your key confidential, and for compliance with Google's terms of service.

We encrypt your API key at rest and use it only to fulfill your render requests. We never use it for our own purposes or share it with third parties.

6. Your content and outputs

Your inputs. Audio files, reference images, lyrics and creative direction you provide remain yours. You grant us a limited license to process them solely to deliver the service.

Generated outputs. Videos generated through your account are yours to use, including for commercial purposes, subject to applicable third-party licenses (e.g. AI provider terms). You are responsible for ensuring you have rights to any audio, lyrics, or reference content you upload.

Your responsibility. You must not upload content you do not own or have permission to use, including copyrighted music without proper rights, or content depicting real persons without their consent. We may suspend accounts that violate this rule.

7. Acceptable use

You agree not to use Arch to generate or distribute content that:

  • infringes intellectual property, trademark, or publicity rights;
  • depicts non-consensual sexual content, including deepfakes of real people;
  • depicts minors in sexual or otherwise harmful contexts;
  • incites violence, hatred, or discrimination;
  • impersonates a real person or organization with intent to deceive;
  • attempts to bypass safety filters or extract our system prompts;
  • violates applicable laws in your jurisdiction.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on severity.

8. Refunds

Subscriptions are non-refundable except where required by law. If a render fails due to a technical issue on our side, the corresponding credits are automatically refunded to your account. For other issues, contact us at the email above.

EU consumers benefit from the 14-day right of withdrawal under Article L. 221-18 of the French Consumer Code, except for digital content delivered and consumed before that period expires (which is the case as soon as you start a render).

9. Service availability

We aim to keep Arch available and performant, but we do not guarantee uninterrupted service. Maintenance, third-party provider outages, or unexpected incidents may temporarily affect availability. We are not liable for losses arising from temporary unavailability.

10. Limitation of liability

To the maximum extent permitted by law, our liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages, including lost profits, data, or business opportunities.

Nothing in these terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any liability that cannot be excluded under French law.

11. Termination

You may close your account at any time from the settings. We may suspend or terminate your account if you breach these terms or use the service in a way that risks harm to other users or to us.

On termination, your access ends and your data is deleted in accordance with our Privacy Policy. Unused monthly credits are forfeited; unused top-up credits may be refunded on a case-by-case basis.

12. Changes to these terms

We may update these terms from time to time. Substantial changes will be announced by email and on this page at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the new terms.

13. Governing law and jurisdiction

These terms are governed by French law. Any dispute arising from these terms or the use of the service will be subject to the exclusive jurisdiction of the competent courts in France, except where mandatory consumer protection rules in your country of residence provide otherwise.
